PLEASE READ THESE TERMS AND CONDITIONS (“TERMS”) CAREFULLY BEFORE USING THIS SITE
1. Who we are and how to contact us
1.1. softpause.com.au is a website (“Site”) operated by Aniya Qarira Muhamad Roslan (we, us and our).
1.2 To contact us, please email hello@softpause.com.au.
1.3 Reference to the Site, includes any goods or products we have listed for sale on the Site from time to time, including topical body care products and skin- applied products such as balms, creams, ointments and any other products we may offer from time to time (“Products”).
2. Agreement
2.1. By using or visiting our Site, you confirm that you accept these Terms and that you have read and agree to comply with them. If you do not agree to these Terms, you must not use our Site. You agree you are at least 18 years old and are using this Site within Australia to make any purchases on our Site.
3. Accounts
3.1 You are responsible for maintaining the confidentiality of your account details, including your password, and for all activities conducted under your account.
3.2 If you become aware of any unauthorised use of your account, you must notify us immediately.
3.3. We may suspend or terminate your account where we reasonably suspect unauthorised use or a breach of these Terms.
4. Placing an Order for Products
4.1 By submitting an Order through the Site (“Order”), you make an offer to purchase the Product(s) in that Order. An email acknowledging receipt of your Order is not acceptance of your Order. A separate contract for each Order is formed only when we accept your Order by issuing a tax invoice or dispatch confirmation.
4.2 Any automated order confirmation, order receipt or similar acknowledgement sent by us is for information only and does not constitute acceptance of your Order.
4.3 Unless otherwise agreed by us, you acknowledge that all Products purchased under these Terms are intended for personal use only and must not be used for any commercial purpose.
4.4 We reserve the right to accept or reject your Order for any reason at any time. If we reject your Order you will receive a refund of any money paid.
4.5 We reserve the right to cancel any Order which we reasonably suspect to be fraudulent or placed in breach of these Terms.
4.6 We may refuse to supply Products to any person where we reasonably consider it necessary to protect our business or to comply with applicable law.
5. Availability of Products
5.1 If a Product the subject of an Order becomes unavailable after your Order is placed, we may contact you to offer a substitute product. We will not supply a substitute product without your consent. If you do not accept the substitute product, we will refund any amount paid for the unavailable Product.
5.2 If your Order is affected by a genuine error (including in a description, an image or price), we reserve the right to cancel your Order and refund any money paid to us.
5.3 You acknowledge and agree that: a) all pictures and images of Products displayed are for illustrative purposes only; and b) any accessory featured with the Product is for illustrative purposes only and may be sold separately.
5.4 Whilst we have made every attempt to show textures, appearances and colours of our Products as accurately as possible, Product images may vary from the delivered Product depending on your monitor, settings and computer equipment. Unless otherwise stated, any additional Products and accessories styled or shown in a Product image are for display purposes only and are not included in the listed price. You must ensure that you carefully read the title and description before making a purchase.
6. Product Recall
6.1 We may, at any time, recall or withdraw any Product from sale for safety, regulatory or quality reasons. Where reasonably practicable, we will notify affected customers and provide an appropriate remedy in accordance with applicable law.
7. Price and Payment
7.1 When you place an Order, we will charge you and you agree to pay the advertised price of the Product and any applicable delivery fee (“Price”).
7.2 All Prices are in Australian Dollars and, unless otherwise stated, are inclusive of GST.
7.3 Payments must be made using the payment methods made available on the Site from time to time, which may include Visa, MasterCard or American Express debit or credit cards, UnionPay, Apple Pay or Google Pay.
7.4 You acknowledge and agree that payments are processed via third party payment providers and that you are bound by the applicable terms and conditions of those providers, which are available on their respective websites.
7.5 We are not responsible for any errors, delays or security breaches caused by third party payment providers.
7.6 Dispatch times may vary according to availability. Any delivery timeframes provided are estimates only and are subject to delays, including delays caused by postal services or events beyond our reasonable control.
7.7 We are not responsible for delays caused by delivery carriers, except to the extent required by applicable law.
7.8 If a payment is declined or fails for any reason, we may cancel your Order or suspend processing until payment is successfully received.
8. Order Cancellation and Returns
8.1 Unless otherwise provided for under these Terms or required by law no cancellations or changes to Orders will be accepted once the order has been placed. You are responsible for ensuring that your Order is accurate before submitting it, including the delivery address.
8.2 Any Product you purchase can only be returned in accordance with these Terms and your rights under applicable consumer laws.
8.3 Where an Order includes multiple Products, we may deliver the Order in instalments or in separate shipments where necessary.
8.4 We are not responsible for delays, failed deliveries or additional costs arising from incorrect delivery details provided with an Order.
8.5 You should inspect the Products as soon as reasonably practicable after delivery and notify us promptly of any damage, defect or discrepancy.
8.6 If you are dissatisfied with your Order due to a legitimate reason such as:
a) the Product was missing items;
b) the Product was damaged; or
c) the Product did not arrive,
we will offer an appropriate remedy in accordance with applicable law. Depending on the circumstances, we may determine the appropriate remedy, which may include a replacement, or full or partial refund of the Price, or store credit.
8.7 To assist us in resolving your request promptly, you should contact customer service at hello@softpause.com.au ] within 7 days of receiving your Order if you believe a Product is faulty, damaged or incorrect. Prompt notification assists processing but does not limit any rights you may have under applicable law.
8.8 No change of mind refunds will be given.
8.9 For hygiene reasons, change of mind returns are not accepted for opened, used or unsealed personal care or skin-applied Products, unless required by law.
8.10 Where refund is approved, it will be processed to the original payment method that was used for the Order.
9. Title and Risk
9.1 Title in the Products passes to you on the later of payment being received in full and delivery of the Products to you by the delivery agent.
9.2 Risk in the Products passes to you on delivery of the Product to you by the delivery agent.
10. Promotions, Discounts and Clearance Items
10.1 Promotions, discounts, or final sale are subject to their own specific terms and conditions as provided by us from time to time.
10.2 Unless otherwise stated, promotional offers, including but not limited to store-wide discounts, clearance final sale, package deals, and coupons, cannot be used in conjunction with any other offer. For example, a ‘$20 Discount’ coupon cannot be used during a ‘20% Off’ Sale.
10.3 Final sale items are items that include a discount of 50% or more. Final sale items are not eligible for refund or exchange unless the Product is faulty or required to be refunded or replaced under applicable law.
10.4 We reserve the right to:
a) terminate, modify or extend any promotional offer at any time, acting reasonably; or
b) cancel any Order to which a promotional discount or code has been applied in error or contrary to the terms and conditions.
11. Use of Products and Safety
11.1 You must use all Products strictly in accordance with any instructions, warnings or directions provided on the Product packaging or on the Site (“Instructions”). If there is any inconsistency, the Product packaging prevails to the extent permitted by law.
11.2 Before using any Product, you should conduct a patch test on a small area of skin to check for any irritation or allergic reaction.
11.3 Products are intended for external use only unless otherwise expressly stated. You must not use the Products on broken, irritated, inflamed or damaged skin, or on the eyes, lips, mouth, genital or other sensitive areas or on any area for which the Product is not intended.
11.4 You must discontinue use immediately if you experience any irritation, discomfort or adverse reaction, and seek medical advice where appropriate.
11.5 You are responsible for reviewing the ingredients of the Products and ensuring that you are not allergic or sensitive to any component. Product formulations may change from time to time, and you should check the ingredients listed on the Product packaging before each use.
11.6 Failure to follow the Instructions may result in injury or adverse effects, for which we are not responsible to the extent permitted by applicable law.
11.7 You are responsible for storing and using the Products in accordance with any instructions provided on the Product packaging or on the Site including any instructions relating to use, storage, handling, care and maintenance. We are not responsible for any loss of efficacy, injury, damage or adverse effects resulting from improper storage, use or handling of the Products, to the extent permitted by law.
11.8 Products must be kept out of reach of children and pets. If a Product is swallowed or comes into contact with the eyes, seek urgent medical attention or contact the relevant Poisons Information Centre in your jurisdiction.
11.9 You should not use a Product if the packaging appears tampered with, opened or damaged on delivery. If this occurs, you should contact us promptly.
12. Warranties
12.1 We warrant to you that any Product purchased from us through the Site will, on delivery:
a) conform with its description;
b) be of acceptable quality; and
c) be reasonably fit for all the purposes for which Products of that kind are commonly supplied.
12.2 Nothing in these Terms excludes, restricts or modifies any rights or remedies you may have under the Australian Consumer Law or any other applicable law.
12.3 To the maximum extent permitted by law, we exclude all other terms, conditions and warranties whether express or implied, relating to the Product or the subject matter of these Terms.
12.4 The content on our Site is provided for general information only and does not constitute advice.
13. Liability
13.1 To the maximum extent permitted by law, our total liability to you arising out of or in connection with the Products or these Terms, whether in contract, tort (including negligence), under statute or otherwise, is limited to the resupply of the Products or the payment of the cost of having the Products resupplied or 5 times the Price paid by you for the Product.
13.2 To the maximum extent permitted by law, we are not liable for any indirect, special or consequential loss, or any loss of profit, revenue, opportunity or goodwill, arising out of or in connection with the Products or these Terms.
13.3 Nothing in these Terms excludes, restricts or modifies any rights or remedies you may have under the Australian Consumer Law or any other applicable law, including any liability which cannot be excluded, restricted or modified.
13.4 Without limiting the above, we are not liable for any adverse reactions, side effects or outcomes resulting from the use or misuse of the Products, including any failure to follow instructions for use, except to the extent such liability cannot be excluded under applicable law.
13.5 Nothing in these Terms will limit a person’s liability for: a) death or personal injury caused by that person’s negligence; b) that person’s fraud; or c) anything else that cannot be limited by law.
14. Disclaimer
14.1 The information and content contained on the Site is not comprehensive and is for general information purposes only. It does not take into account your specific needs, objectives or circumstances, and does not constitute medical, dermatological or other professional advice.
14.2 While we use reasonable endeavours to ensure the accuracy and completeness of the information and content, we make no representation or warranty in relation to it, to the maximum extent permitted by law.
14.3 Our Products are intended for general cosmetic and topical use only and are not intended to diagnose, treat, cure or prevent any medical condition.
14.4 You acknowledge that individual results may vary and that the use of our Products may result in skin irritation, allergic reactions or other adverse effects in some individuals. You are responsible for determining whether a Product is suitable for your personal use.
14.5 If you have sensitive skin, allergies, a skin condition, are pregnant or breastfeeding, are using prescription skin treatments, or have any other relevant medical concern, you should carefully review the ingredients, warnings and Instructions for Use before using any Product, and obtain medical advice where appropriate.
15. Prohibited Uses
15.1 You must not do or attempt to do anything that is unlawful; prohibited by any laws applicable; which we consider inappropriate; or which may bring us or our Site into disrepute, including (without limitation):
a) anything that would constitute a breach of an individual’s privacy (including uploading private or personal information without an individual's consent) or any other legal rights;
b) disclosing any user identification codes, password or any other piece of information as part of our security procedures, which are confidential to any third party;
c) using the Site or our Products in any way that competes with our business;
d) using our Site to defame, harass, threaten, menace or offend any person;
e) interfering with any other person’s use or enjoyment of our Site;
f) tampering with or modifying or damaging our Site, knowingly transmitting viruses or other harmful codes, or using any trojan horses, viruses or other malicious programs;
g) using our Site to send unsolicited electronic messages; or
h) facilitating or assisting a third party to do any of the above acts.
15.2 In the event of such a breach, your right to use our Site will cease immediately.

16.1 You agree that we collect, use, hold and disclose your personal information in accordance with our Privacy Policy and applicable privacy laws, including the Privacy Act 1988 (Cth) and the Australian Privacy Principles, where applicable.
16.2 By using our site, you consent to receiving communication from us , including emails relating to your Orders, our Products and our services, in accordance with our Privacy Policy. Please see our Privacy Policy for information about our privacy practices.
17. Intellectual Property
17.1 We are the owner or the licensee of all intellectual property rights in our Site, our Products, and in the material published on the Site. All such rights are reserved.
17.2 We grant you a limited, non-exclusive, non-transferable licence to access and use the Site for personal, non-commercial purposes, subject to these Terms.
17.3 You must not reproduce, distribute, modify or exploit any content on the Site without our prior written consent.
18. Termination
18.1 We may suspend or terminate your access to the Site, or your account, at any time where:
a) you breach these Terms;
b) we reasonably suspect unauthorised or fraudulent activity; or
c) we reasonably consider it necessary to protect our business, other users or the integrity of the Site.
18.2 We may suspend or withdraw the Site, or any part of it, at any time for operational, legal or business reasons.
18.3 Termination or suspension does not affect any rights or liabilities that have accrued prior to termination, including any obligation to pay for Products already ordered.
18.4 You may stop using the Site at any time.
19. We may make changes to these Terms
19.1 We may amend these Terms from time to time. Every time you wish to use our Site, please check these Terms to ensure you understand the Terms that apply at that time. By continuing to use our Services after the amendments take effect, you agree to be bound by the Terms as amended.

20. We may make changes to our Site
20.1 We may update and change our Site from time to time to reflect changes to our Products, our users' needs, changes in law and our business priorities.
21. We may suspend or withdraw our Site
21.1 Our Site is made available free of charge.
21.2 We do not guarantee that our Site, or any content or Products on it, will always be available, uninterrupted or be error-free. We may suspend or withdraw or restrict the availability of all or any part of our Site or Products for business and operational reasons.
21.3 We will try to give you reasonable notice of any suspension or withdrawal.
21.4 This Site is provided on an "as is" and "as available" basis, and we make no representations or warranties, express or implied, regarding the operation or availability of the Site.
22. We are not responsible for viruses
22.1 We do not guarantee that our Site will be secure or free from bugs or viruses or any other type of malicious code or software.
22.2 You are responsible for configuring your technology to access our Site. You should use your own antivirus software.
23. We are not responsible for websites we link to
23.1 Where our Site contains links to other sites (including banner advertisements and sponsored links) and resources provided by third parties, these links are provided for your information only and you access third party websites subject to the terms and conditions for those websites.

24.1 Additional terms and conditions may also apply to specific portions, services or features of the Site. All such additional terms and conditions are incorporated by this reference into these Terms.
25. General
Disputes: In the event of any dispute arising from, the parties must attempt to resolve the dispute in good faith. If the parties do not resolve the dispute between themselves, they may refer the dispute to a mediator.
Force majeure: No party will be liable to another if it fails to meet its obligations due to matters beyond its reasonable control, including but not limited to an act of god, strike or pandemic.
Severability: Any provision of these Terms which is void, illegal or otherwise unenforceable will be severed to the extent permitted by law without affecting any other provision of the Terms.
Relationship: These Terms do not confer an agency, partnership, joint venture, employee-employer or franchisor-franchisee relationship between us and you or any other party unless expressly stated otherwise.
Entire agreement: These Terms form the entire agreement between the parties in relation to the Products. It replaces any earlier agreements, representations or discussions. This clause survives termination of these Terms.
Compliance with laws: You are responsible for complying with all applicable laws when accessing or using the Site or Products.
Jurisdiction: These Terms are governed by the laws of Victoria. You irrevocably and unconditionally submit to the exclusive jurisdiction of the Victoria courts. Although the Services may be accessed throughout Australia and overseas, we make no representations or warranties that its content, or the Products, comply with the laws (including intellectual property laws) of any country outside Australia. If you access the Site from outside Australia, you do so at your own risk and are responsible for ensuring compliance with all laws in the place where you are located. This clause survives termination of these Terms.
